As the statutory deductibles in Ontario are indexed for inflation in motor vehicle accidents, the Financial Services Regulatory Authority of Ontario (FSRA) has provided the indexation amounts for the statutory deductibles in relation to automobile accidents for 2021.

As of 2021, in order to recover any non-pecuniary damages, a claim will have to exceed $39,754.31. Thus, if an injured person is awarded $45,000 in general damages at trial, that person will recover $5,245. 69.
In order to recover damages where the deductible does not apply, the injured parties award must now exceed $132,513. 28.
